These Terms of Service ("Terms") govern your access to and use of RetroPlayland (the "Service"), an online retro video game preservation portal operated by an independent operator ("the Operator", "RetroPlayland", "we", "us" or "our"). Please read these Terms carefully, together with our Privacy Policy, Cookie Policy and DMCA / Copyright Policy, which are incorporated into these Terms by reference. By accessing or using the Service, you agree to be bound by these Terms.
By accessing, browsing, registering for, or otherwise using the Service in any way, you acknowledge that you have read, understood and agree to be legally bound by these Terms and by all documents incorporated by reference, including the Privacy Policy, the Cookie Policy and the DMCA / Copyright Policy. If you do not agree with any part of these Terms, you must not access or use the Service.
These Terms form a binding agreement between you and the Operator. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation, and "you" refers to both you and that organisation. Your continued use of the Service following any change to these Terms constitutes acceptance of the revised Terms.
The Service is not directed to children. You may only use the Service if you are at least the age of digital consent applicable in your jurisdiction. In the European Union, the United Kingdom and Switzerland this is generally 16 years of age (or such lower age as set by your member state, but not below 13). In the United States, the Service is not directed to and does not knowingly collect personal information from children under 13.
By using the Service, you represent and warrant that you meet the applicable minimum age requirement and that you have the legal capacity to enter into these Terms. If you are below the age of majority in your jurisdiction but above the applicable minimum age, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. If we become aware that we have collected personal data from a child below the applicable age without appropriate consent, we will take steps to delete that information as described in the Privacy Policy.
RetroPlayland is a cultural-preservation and educational archive dedicated to the history of retro video gaming. The Service allows users to play classic games from a range of historical consoles and home computers directly in their web browser through WebAssembly-based emulation technology (including EmulatorJS and js-dos), without requiring downloads or installation.
The Service is provided free of charge and is funded by advertising. Creating an account is optional and free; an account unlocks additional features such as ratings, comments and favorites. The Service is offered for purposes of historical preservation, study, research and personal entertainment.
We do not guarantee that any particular game, title, system, feature or function will be available, complete, accurate, error-free or compatible with your device or browser. We may add, change, restrict or remove games, systems, features or functionality at any time without notice. Emulation accuracy varies and is dependent on third-party emulation engines that we do not control.
You may use much of the Service without an account. To access certain features (such as posting ratings, comments and forum posts, or saving favorites), you must register an account by providing accurate, current and complete information, including a valid email address, username and display name. You agree to keep your account information accurate and up to date.
You are responsible for safeguarding the credentials used to access your account and for all activity that occurs under your account. Passwords are stored using strong cryptographic hashing (Argon2id) and are never accessible to us in plain text. You agree to use a strong, unique password, to keep it confidential, and to notify us immediately at support@retroplayland.com of any unauthorised use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your credentials.
You are solely responsible for all content you submit and all actions taken through your account. You may not share, sell, transfer or assign your account to any other person, nor use another person's account without permission. You may not create an account using false information or impersonate any person or entity.
You may stop using the Service and request deletion of your account at any time. Upon a verified request, your account data will be deleted in accordance with the Privacy Policy, subject to any retention required to comply with legal obligations or to prevent abuse.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree that you will not, and will not permit or assist any third party to:
We reserve the right to investigate suspected violations and to take any action we deem appropriate, including removing content, suspending or terminating accounts, and reporting conduct to law enforcement authorities.
The Service allows you to submit content such as ratings, comments, forum posts and reports ("User Content"). You retain ownership of any intellectual property rights you hold in your User Content. You are solely responsible for your User Content and for the consequences of submitting it.
By submitting User Content, you grant the Operator a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable and transferable licence to host, store, reproduce, display, publish, adapt, translate, moderate, distribute and otherwise use your User Content in connection with operating, providing, promoting and improving the Service. This licence survives termination of your account to the extent reasonably necessary for backup, legal-compliance, dispute-resolution and the integrity of existing discussions.
You represent and warrant that you own or have all necessary rights to your User Content and that its submission and use as described does not infringe or violate the rights of any third party or any applicable law.
We do not endorse and are not responsible for any User Content, which reflects the views of the user who submitted it and not those of the Operator. We have the right, but not the obligation, to monitor, review, edit, refuse, remove or restrict any User Content at our sole discretion, with or without notice, including content we consider prohibited under Section 5 or otherwise objectionable. Removal or moderation of User Content does not waive any of our rights.
RetroPlayland is operated as a cultural-preservation and educational archive of retro gaming history. Games are made available for the purposes of historical preservation, study, research and personal entertainment.
All game titles, trademarks, service marks, trade names, logos, characters, artwork, music, audiovisual elements and copyrights referenced or made available through the Service are the property of their respective owners. The Operator claims no ownership of, and asserts no proprietary rights in, any such third-party intellectual property.
The Operator is independent and is not affiliated with, endorsed by, sponsored by, or in any way officially connected to any rights holder, console manufacturer, developer, publisher or other entity whose products, trademarks or works may appear on the Service. Any references to such names are for identification, descriptive, historical and educational purposes only and constitute nominative or descriptive use.
The Service's original elements — including its design, layout, compilation, organisation, software, text we author, and the "RetroPlayland" name and branding — are owned by the Operator or its licensors and are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute or create derivative works from these elements without our prior written consent.
We operate a notice-and-takedown process and will promptly remove allegedly infringing content upon receipt of a valid notice. If you believe content on the Service infringes your copyright or other rights, please review and follow our DMCA / Copyright Policy and contact dmca@retroplayland.com. We reserve the right to remove any content and to terminate the accounts of repeat infringers.
The Service may contain links to, or content from, third-party websites, services, resources, emulation engines or advertisers that are not owned or controlled by the Operator. We provide such links and content for convenience and informational purposes only and do not endorse and are not responsible for the availability, accuracy, content, products, services, practices or policies of any third party. Your use of third-party websites and services is at your own risk and subject to their own terms and policies. The Operator shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any third-party content, goods or services.
The Service is funded by advertising. We display advertisements through Google AdSense and Google advertising partners (including DoubleClick / googlesyndication / doubleclick.net domains), which may use cookies and similar technologies for ad serving, measurement, frequency capping and — where you provide consent — personalised advertising. Where required, EU, UK and Swiss users are offered a consent choice.
Any interaction you have with advertisements or advertisers found on or through the Service — including the purchase of, or correspondence regarding, goods or services, and any terms, conditions, warranties or representations associated with such dealings — is solely between you and the relevant advertiser. The Operator is not a party to, and is not responsible or liable for, any such dealings.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL CONTENT, GAMES, FEATURES AND MATERIALS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE. THE OPERATOR EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, THE OPERATOR DOES NOT WARRANT OR GUARANTEE THAT: (a) the Service will be uninterrupted, secure, timely or error-free; (b) any games will function correctly, be complete, accurate or available; (c) any defects will be corrected; (d) the Service or the servers that make it available are free of viruses or other harmful components; or (e) the results obtained from using the Service will meet your requirements or expectations. No advice or information, whether oral or written, obtained from the Operator or through the Service creates any warranty not expressly stated in these Terms. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE OPERATOR, ITS OWNERS, OPERATORS, CONTRIBUTORS, LICENSORS OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, USE OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE OR ANY OTHER LEGAL THEORY, EVEN IF THE OPERATOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF THE OPERATOR FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (a) THE TOTAL AMOUNT YOU PAID TO THE OPERATOR FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM (WHICH, FOR A FREE SERVICE, IS ZERO), OR (b) ONE HUNDRED EURO (EUR 100), OR THE EQUIVALENT IN YOUR LOCAL CURRENCY.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law. Where liability cannot be excluded but can be limited, the Operator's liability is limited to the maximum extent permitted by law. If you are a consumer, these limitations apply only to the extent permitted by the mandatory consumer-protection laws applicable to you, and they do not affect your statutory rights.
You agree to defend, indemnify and hold harmless the Operator and its owners, operators, contributors, licensors, suppliers and agents from and against any and all claims, demands, actions, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or related to: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms or any incorporated policy; (d) your violation of any law or the rights of any third party; or (e) any misuse of the Service through your account. The Operator reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate with the Operator's defence of such claim. This Section applies to the maximum extent permitted by applicable law and, where you are a consumer, only to claims arising from your breach of these Terms or your unlawful or negligent conduct.
You acknowledge and accept that you use the Service voluntarily and at your own risk. You assume all risks associated with using browser-based emulation, including the possibility that games may fail to load, may crash, may behave unexpectedly, may not save progress, or may be incompatible with your device or browser. You are responsible for ensuring that your use of the Service is permitted in your jurisdiction and for maintaining appropriate security and backups on your own devices.
We may, at our sole discretion and to the maximum extent permitted by law, modify, suspend, restrict or terminate the Service, any feature, or your account or access to all or part of the Service at any time, with or without notice and with or without cause, including where we reasonably believe you have violated these Terms or applicable law, or to protect the integrity, security or operation of the Service.
Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination — including those relating to User Content licences, intellectual property, disclaimers, limitation of liability, indemnification, governing law and these general provisions — shall survive. We may retain and remove your content and data in accordance with the Privacy Policy and applicable law.
The Operator shall not be liable for any failure or delay in performing, or for any unavailability of, the Service to the extent caused by circumstances beyond its reasonable control, including acts of God, natural disasters, epidemics or pandemics, war, terrorism, civil unrest, government action, labour disputes, failures or interruptions of internet, hosting, content-delivery, power or telecommunications infrastructure, third-party service or emulation-engine failures, cyber-attacks or denial-of-service events.
We may amend these Terms and the incorporated policies from time to time. When we make material changes, we will update the "Last updated" date and provide reasonable notice via the Service, such as by posting the revised Terms on the site. Changes are effective when posted unless otherwise stated. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service. We also reserve the right to change, suspend or discontinue any aspect of the Service at any time as described in Section 14.
These Terms and any dispute or claim arising out of or in connection with them, their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict-of-laws principles. You agree that the courts located in Poland shall have exclusive jurisdiction to resolve any such dispute, except where mandatory consumer-protection laws of your country of residence provide otherwise.
If you are a consumer resident in the European Union, the United Kingdom or another jurisdiction with mandatory consumer-protection rules, nothing in this Section deprives you of the protection afforded by, or your right to bring proceedings under, the mandatory laws of your country of habitual residence. Where required, EU consumers may also access the European Commission's Online Dispute Resolution platform.
If any provision of these Terms is held to be invalid, illegal or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or, if it cannot be so modified, severed, and the remaining provisions shall continue in full force and effect.
No failure or delay by the Operator in exercising any right, power or remedy under these Terms shall operate as a waiver of it, nor shall any single or partial exercise preclude any further exercise. Any waiver must be in writing to be effective.
These Terms, together with the Privacy Policy, the Cookie Policy and the DMCA / Copyright Policy, constitute the entire agreement between you and the Operator regarding the Service and supersede all prior or contemporaneous agreements, understandings and communications, whether oral or written, relating to its subject matter.
You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, reorganisation or sale of assets.
Except for the Operator's owners, operators, contributors, licensors, suppliers and agents (who may enforce the disclaimer, limitation-of-liability and indemnification provisions), these Terms do not create any rights enforceable by any third party.
Section headings are for convenience only and do not affect interpretation. The words "including" and "include" are illustrative and not limiting.
