This Privacy Policy explains who we are, what personal data we collect when you use RetroPlayland (the "Service", at https://retroplayland.com), how and why we use it, the legal bases on which we rely, who we share it with, and the rights you have over your data. RetroPlayland is operated by an independent operator ("the Operator", "RetroPlayland", "we", "us", "our"). The Operator is the data controller responsible for the personal data processed in connection with the Service, except where this Policy states that a third party (such as Google) acts as an independent controller for its own purposes.

This Policy applies to personal data we process about visitors and registered users of the Service. It does not apply to third-party websites, services or platforms that we link to or that serve content (such as advertising) through the Service; those operate under their own privacy policies, as further described in Sections 6 and 8.
We aim to collect the minimum personal data necessary to operate the Service. We collect the following categories.

An account is optional and is only needed to unlock features such as ratings, comments and favorites.
When you use interactive features we process the content you submit, including ratings, comments, forum posts, favorites and reports ("User Content"), together with associated metadata (for example timestamps and the account that created the content).
When you use the Service we automatically collect technical and usage information, including pages and games accessed, referring pages, approximate interaction data, browser and device type, operating system, and similar diagnostic information. Our analytics are privacy-respecting and first-party.
We process your IP address and related connection information for security, rate-limiting, abuse prevention and automated bot/crawler detection.
We and our advertising partners use cookies and similar local storage. Our own first-party cookies/identifiers include a session cookie, a CSRF token, rp-lang (language), rp-theme (theme) and _rp_sk (a first-party analytics session key). We do not intentionally collect special categories of personal data (such as data revealing health, religion or political opinions), and we ask that you do not submit such data through User Content.
We process personal data only where we have a lawful basis to do so under the EU General Data Protection Regulation (GDPR) and the UK GDPR. The following sub-sections map each purpose to its legal basis.

To fund the free Service through advertising served by Google AdSense and Google's ad partners. Legal basis: our legitimate interests in funding the Service through non-personalised advertising; and, for personalised advertising and the cookies it requires in the EU, UK and Switzerland, your consent. To respond to your enquiries, send service-related and security notices, and process requests. Legal basis: performance of a contract, our legitimate interests in responding to you, and compliance with legal obligations.
To comply with applicable law, respond to lawful requests (including DMCA notices under our DMCA / Copyright Policy) and establish, exercise or defend legal claims. Legal basis: compliance with a legal obligation and our legitimate interests in protecting our rights.
Where we rely on legitimate interests, we have balanced those interests against your rights and freedoms; you may object as described in Section 11. We do not use your personal data to make decisions based solely on automated processing that produce legal or similarly significant effects on you; our automated bot/crawler detection is used only to protect the Service and does not produce such effects on legitimate users.
The Service uses cookies and similar technologies for strictly necessary functions (such as sessions and security), preferences, analytics and advertising. EU, UK and Swiss users are presented with a consent choice for non-essential cookies where required, and you can change your choices at any time. The Service is funded by advertising. We use Google AdSense and Google's advertising partners, which may set and read third-party cookies and similar identifiers via domains such as googlesyndication.com and doubleclick.net (DoubleClick) to serve ads, measure performance, cap frequency and, where consent is given, deliver personalised advertising.

We operate privacy-respecting first-party traffic statistics and automated bot/crawler detection. As part of this, your IP address and connection data are processed for security, rate-limiting and abuse prevention. These functions are essential to keeping the Service available, accurate and secure.

Some recipients (including Google and certain infrastructure providers) may process personal data outside the European Economic Area, the United Kingdom or Switzerland. Where we transfer personal data to a country that does not benefit from an adequacy decision, we rely on appropriate safeguards, in particular the European Commission's Standard Contractual Clauses (and the UK International Data Transfer Addendum / Agreement where applicable), together with supplementary measures as needed. We keep personal data only for as long as necessary for the purposes set out in this Policy, and in any event minimal and proportionate. In particular:

To exercise any right, contact privacy@retroplayland.com. We may need to verify your identity before acting, and we will not charge a fee unless your request is manifestly unfounded or excessive. We will respond within the timeframes required by law (generally one month under the GDPR / UK GDPR). EU users may complain to the data protection authority of their member state; UK users may complain to the Information Commissioner's Office (ICO) at https://ico.org.uk. We would, however, appreciate the chance to address your concerns before you do so.
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, gives you rights to know, access, correct and delete personal information, and to limit certain uses of sensitive personal information. We do not sell your personal information, and we do not "share" it for cross-context behavioural advertising as those terms are defined under California law, except to the extent advertising cookies may constitute such sharing, in which case you may opt out via our cookie/consent controls. You may also exercise applicable rights by contacting privacy@retroplayland.com, and we will not discriminate against you for doing so.
The Service is not directed to children under the applicable digital-consent age (16 in the EU/UK unless a lower age is set by national law, and under 13 in the United States). We do not knowingly collect personal data from such children. If you believe a child has provided us with personal data, please contact privacy@retroplayland.com and we will take steps to delete it.
We implement appropriate technical and organisational measures to protect personal data, including encryption of traffic over HTTPS, hashing of passwords with the Argon2id algorithm, access controls, and security monitoring including bot/crawler detection and rate-limiting. However, no method of transmission or storage is completely secure, and the Service is provided on an "AS IS" and "AS AVAILABLE" basis as described in our Terms of Service; we cannot guarantee absolute security.
We may amend this Privacy Policy from time to time. Where changes are material, we will provide notice via the Service. The "Last updated" date above indicates when the Policy was last revised. Your continued use of the Service after changes take effect constitutes acknowledgement of the updated Policy.
